Gas Safety Responsibilities

If you are a landlord or an agent, there are certain regulations that apply with regard to the obtaining and indeed the provision of Gas Safety Certificates to tenants. It is actually both the landlord and the agent that are responsible and it is best if both hold a copy of the Gas Safety Certificate.

A landlord’s Gas Safety Certificate must be completed and provided to the tenant before they move into the property and then within 28 days of each annual renewal. Failure to do so can result in a penalty of up to £5,000.00 or up to six months in prison!

Similarly, failure to maintain a tenant’s gas appliances also risks prosecution as this can result in injury or loss of life. In this case non-compliance can result in imprisonment or a fine of up to £20,000.00, or both, and for each offence. If the case is referred to the Crown Court then the maximum penalty is an unlimited fine plus potential imprisonment.
